Section 8 duties, a safe place, safe systems, training and supervision, are delegated down the management line: the operations manager owns the systems, the supervisor owns the supervision, the site manager owns the site. The safety statement under Section 20 must name the people responsible for each task, so managers appear in it by name and title. Section 13 applies to managers as employees too.
Where an offence under the Act is committed by a body corporate and is proved to have been authorised, or consented to, or attributable to connivance or neglect by a director, manager or other officer, that person is also guilty of the offence. The section presumes, unless the contrary is proved, that a director or manager consented to the doing of the acts that constituted the offence where the body corporate is convicted. Directors and managers have been prosecuted personally in Ireland following workplace deaths.
Know the hazards of your area and make sure the risk assessments are current and the controls actually in place. Induct every new starter and never let anyone do a task they have not been trained for. Supervise: walk the floor, look, ask and correct. Section 18 requires the employer to appoint competent people to assist; a manager's job is to use them.
